| Tiivistelmä: | This article examines the use of preliminary objections to panel requests and terms of reference and the manner in which they have been resolved by GATT and WTO dispute settlement panels and the WTO Appellate Body. The article commences by briefly considering the substantive requirements of the relevant treaty provisions, Articles 6.2 and 7.1 of the DSU, and the objectives underlying these provisions. With this background in mind, it proceeds to categorize the various subject-matter of preliminary objections to the panel request and terms of reference, illustrating how the approach applied by panels and the AB in dealing with such objections has evolved over the first five years of the WTO dispute settlement system. |
