Abstract (eng): | Subject of this master's thesis is Regulation of Water Utilities' Business Operations. This work is done from the utilities' customers' point of view. Thesis is done for the Finnish Environment Institute on the assignment of the Ministry of Agriculture and Forestry. Water utilities' environment is changing and municipalities are interested in public private-partnership and are also incorporating their activities and making their own utilities to work as a public utility. Water and wastewater services are becoming more like a business activity. As public-private-partnership is becoming more popular, it needs to be supervised. The interests of customers have to be secured, because water services are a necessity, to which every citizen has a right. This master's thesis presents different ways of how we can organize the supervision. There are two means: public control and official supervision. Disadvantages caused by the lack of supervision include, for example, the excessive returns for the municipality that are common to the biggest municipalities. Other problems are, for example, that customers do not know how the charges are allocated and whether those charges are equitable and reasonable. There are also problems with the quality of service certainty and service accessibility. Citizens have the right to access the network and it is the municipalities' responsibility to organize the water supply and wastewater services in planned areas. Water utility is a natural monopoly and therefore the interests of the customers have to be secured well. The following officials' potential to supervise the utilities is being explored in this study: municipalities, a new national office, Finnish Competition Authority, Energy Market Authority, Regional Environment Centres and The Employment and Economic Development Centres. Also other means to reduce disadvantages is discussed. This work concludes some alternatives to improve the supervision. Suggested operations are to study Energy Market Authority as a supervisor in more detail, to study the possibility of forming a national committee and to develop internal auditing of the municipalities. |
Abstract (fin): | Tämä diplomityö käsittelee vesihuoltolaitosten liiketoiminnan valvontaa vesihuoltolaitosten asiakkaiden näkökulmasta. Työ on tehty Suomen ympäristökeskukselle Maa- ja metsätalousministeriön toimeksiantona. Vesihuoltolaitosten toimintaympäristö on muuttunut, ja kunnat yhtiöittävät, liikelaitostavat ja muutoin ulkoistavat toimintaansa. Toiminta on yritysmäisempää kuin ennen. Toimintojen ulkoistuessa on tarpeen huolehtia vesihuoltopalveluiden varmuudesta, saatavuudesta ja asiakkaiden etujen turvaamisesta. Ulkoistamisen lisääntyessä tulee valmistautua myös ulkoistetun toiminnan valvomiseen, sillä vesihuolto on välttämättömyyspalvelu, johon kuntalaisilla on oikeus. Tämä diplomityö perehtyy siihen, kuinka liiketoiminnan valvonta voidaan järjestää. Vaihtoehtoja on kaksi: julkisuusvalvonta ja viranomaisvalvonta. Valvonnan puutteesta johtuvia haittoja ovat muun muassa suurimpien laitosten tulouttamat suuret tuotot. Muita ongelmia ovat vesihuoltolaitosten asiakkaiden tietämättömyys siitä, mihin heidän maksamansa maksut kohdistuvat ja mistä maksut ylipäätänsä koostuvat. Myös palvelujen laadun varmentamisessa ja saatavuudessa on ongelmia. Kuntalaisella on oikeus liittyä verkostoon ja kunnalla on velvollisuus järjestää vesihuolto kaavoitetulla alueella. Ulkoistettua toimintaa voidaan valvoa vain hyvien sopimusten ja lakien avulla. Koska suuntana on liikelaitostaminen ja yhtiöittäminen, tulee selvittää myös miten yksityisten laitosten valvontamahdollisuuksia voidaan parantaa. Vesihuoltolaitos on luonnollinen monopoli ja siksi asiakkaan edut on turvattava hyvin. Seuraavien viranomaisten mahdollisuudet valvontaan on tutkittu tämän työn puitteissa: kunta, uusi valtakunnallinen virasto, Kilpailuvirasto, Energiamarkkinavirasto, alueelliset ympäristökeskukset ja TE-keskukset. Viranomaisvalvonnan lisäksi on käsitelty myös muita keinoja haittojen poistamiseksi. Tämän työn perusteella ehdotettavia toimenpiteitä ovat jatkotutkimukset valvonnan antamisesta Energiamarkkinavirastolle, uuden valtakunnallisen lautakunnan perustamisen tutkiminen tarkemmin ja kuntien sisäisen kontrollin kehittäminen vesihuollossa. |
