| Abstract (eng): | The municipal is responsible for spatial planning and implementation of its own territory. Principles for these obligations are described in the municipal land policy. According to Land Use and Building Act the landowner is obliged to share the costs incurred by the local authority from community building. Land use agreements are one way to share these costs. This thesis deals with municipal land policy, land use agreements and the equality of landowners. Also other issues such as the economic impacts of the planning and land use agreements have to municipalities are described in this thesis. According to Land Use and Building Act the plans must be prepared in interaction with such persons and bodies on whose benefits the plan may have substantial impact. The participation and assessment scheme contains the principles of the planning and also the information about the land use agreements. The agreements often contain relevant information about the plan. Because the municipalities have different kinds of practices about land use agreements, it is essential that the landowners have the opportunity to get this information. The empirical part of the thesis examines the land policy of the three major tourist resorts in Lapland. These resorts are municipals Kittilä, Kolari and man. Ali these municipals have the same kind of principles about planning and the use of land. The most important land policy principles are equal treatment of landowners and creation of long term plans. Land use agreements are generally used in all of these municipalities. The terms of the agreements are quite similar and the costs incurred by the local authority from community building are reasonable. Land policies are very consistent and open in all of these municipalities. Planning and land use have significant economical impact to municipalities. The economical effects depend on the matters in which the municipality exercises its land policy. Therefore, in this thesis, it was suggested that further studies should be conducted about the economical impacts that the land policy has to municipalities. |
| Abstract (fin): | Kunnan on huolehdittava alueiden käytön suunnittelusta ja toteuttamisesta omalla alueellaan. Kunnan maapolitiikka linjaa ne periaatteet, joilla kunta tätä velvoitettaan toteuttaa. Maapoliittisista keinoista maankäyttösopimukset ovat monessa kunnassa muodostuneet keskeiseksi keinoksi sopia maanomistajan kanssa maankäyttö- ja rakennuslain mukaisesta velvollisuudesta osallistua kunnalle yhdyskuntarakentamisesta aiheutuviin kustannuksiin. Tässä työssä tarkastellaan maankäyttösopimusten merkitystä niin maapolitiikan ja kaavoituksen kuin maanomistajien yhdenvertaisuuden ja kuntatalouden näkökulmasta. Maankäyttö- ja rakennuslain keskeisenä elementtinä on maankäytön suunnittelun vuorovaikutteisuus. Osallistumis- ja arviointisuunnitelmasta kaavoituksen osalliset saavat tarpeelliset tiedot kaavoitukseen liittyvistä seikoista, kuten alueen maankäyttösopimuksista. Maankäyttösopimuksien sääntely on varsin niukkaa eikä kuntien välillä ole yhtenäistä käytäntöä. Kun maankäyttösopimusten käyttö jatkuvasti lisääntyy, tulee kuntien maankäytön suunnittelun olla yhä avoimempaa salaisten pöytälaatikkosopimusten välttämiseksi. Tutkimuksen kohteena olevissa Lapin kunnissa, Kittilässä, Kolarissa ja Inarissa, maapolitiikan periaatteet ja toteuttamiskeinot ovat varsin yhtenäisiä. Kuntien maapolitiikan perustana on matkailukeskusten pitkäjänteinen kehittäminen yhteistyössä maanomistajien kanssa. Maankäyttösopimukset on koettu parhaana maapoliittisena keinona näiden tavoitteiden saavuttamiseksi. Tutkimuksessa todettiin, että kuntien maapolitiikka matkailukeskusten alueella on selkeää, vaikka joitakin puutteitakin havaittiin. Maankäyttösopimukset ovat lähtökohtaisesti selkeitä ja niissä noudatetaan kunnanvaltuustojen linjaamia periaatteita kustannusten korvauksista. Maankäyttösopimukset ovat kunnissa varsin samansisältöisiä ja maanomistajille aiheutuvien kustannusten määrät ovat kohtuullisia eivätkä olennaisesti poikkea toisistaan. Kunnan kaavoituksen ja maankäytön ratkaisut vaikuttavat merkittävästi kunnan talouteen ja toimintaan. Tutkimuksessa ehdotettiinkin vertailevan selvityksen tekemistä eri maapoliittisten keinojen taloudellisten seikkojen vaikutuksesta kuntatalouteen. |
