| Abstract: | The issue of damage valuation resulting from a violation of contract terms is an increasingly important area of corporate litigation. Yet it has received virtually no consideration in the finance literature. The paper derives a valuation of damages used in recent expert testimony. In includes the application of methodologies such as analyzing the yield curve, applying the CARM, using an appropriate cost of capital framework and determining a divisional cost of capital. |
