| Tiivistelmä: | This article examines the effects of the so-called "Posting of Workers Directive". The purpose of the directive was to create a legal frame for labour conditions of workers posted temporarily another European Union Member State. Its main objectives are equal treatment, free movement of services, ensuring minimum protection of worker's rights, and respect for the regulatory frame in the host country. This article investigates the national implementation and practice concerning the issues of the directive. The cases of Great Britain, Germany, Netherlands, Belgium and the Nordic models are presented. Those cases illustrate that increased divergence can be observed with regards to regulation and control. However, there is a growing tension between the balance between free movement of services and protecting of worker's rights. Some unwanted development caused by this directive have prompted attempts to reinforce member state control. It seems that the role of European Commission has shifted towards the free market camp. In addition, European Parliament is seen as the main defender of equal treatment and host country principles. |
